By posting a job, you acknowledge reading and accepting these terms conditions and you represent, warrant and agree that you are not in violation of our policies and standards. You further agree that any such violation will cause us damages, the reasonable approximation of which is equal to the posting fee; accordingly, the fee you pay will be forfeited. Nature of Agreement
You acknowledge acceptance of the fee(s) set forth on our site. We may modify, suspend or terminate your services (or delete your information from the system) at any time for any reason without notice, with a refund only of any prepaid, but theretofore unapplied, fees (subject to the foregoing paragraph).
You hereby grant to us and to the public the right to use, copy or modify, in any form any communications or information you utilize on the HighCountryJobs.com system. You shall have absolutely no recourse against us as the HighCountryJobs.com system provider for any alleged or actual infringement of any of your proprietary rights. You hereby grant us the right to use your name in connection with our promotion of the HighCountryJobs.com system. In using the HighCountryJobs.com system, you will abide by all applicable laws, rules and regulations, including equal opportunity laws, and will not use the system to commit a crime, libel,slander, obscenity, indecency, intellectual property infringement, or to plan, or encourage or help others, to do so.
The HighCountryJobs.com System is provided "as is" and we make no warranties, express or implied, as to the merchantability, fitness for a particular use or purpose, title, non-infringement or otherwise. Your and your applicants' use of our system, including the content thereof, is entirely at your sole risk; and that your use is expressly limited to your recruiting of employees in accordance with our policies. We will not be responsible to you or any third parties for any direct or indirect, consequential, special or punitive damages or losses you may incur in connection with or relating to our system. In the event the foregoing limitation is not enforceable in any state, our maximum liability shall be limited to the fee for a single job posting.You will defend, indemnify, and hold us harmless from all claims, liabilities, losses and expenses (including reasonable attorneys fees), relating to any acts, or failures to act, by you or materials or information transmitted by you in connection with our system.
These terms represent the entire binding agreement between Advertiser and HighCountryJobs.com and supersede any and all prior understanding, statements or representations regarding HighCountryJobs.com. You will ensure that all of your employees and representatives using, or otherwise having access to, the system do so only in strict accordance with these terms. No provision hereof may be amended, modified, assigned or waived by you, except in a writing signed by both parties. These terms shall be governed by internal Colorado and relevant federal laws, and exclusive jurisdiction and venue for any action shall be had in the state and federal courts located in Eagle County.(The prevailing party in any such action shall be entitled to reasonable attorneys' fees.) These terms shall be severable and construed to the extent of their enforceability in light of the parties' mutual intent if deemed at all unenforceable by a competent court. Given the nature of the last sentence of Rights, Responsibilities, and Laws, you understand and agree that, in addition to money damages, we will be entitled to equitable relief upon a breach thereof.
